We have not appointed a data protection officer because the legal requirements for doing so (Art. 37 GDPR in conjunction with Section 38 BDSG) are not met.

2. Provision of the website (hosting)

This website is delivered through Firebase Hosting, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). When you open a page, Google processes technically necessary data sent by your browser: IP address, date and time, requested address, referrer URL, browser type and operating system. The website cannot be delivered without this data.

Purpose: delivering the website, stability and protection against attacks. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in a secure and functioning website). Google processes the data as our processor under Google’s data processing terms (Art. 28 GDPR). We do not analyse this data ourselves.

Google may transfer data to Google LLC in the USA. Google LLC is certified under the EU-US Data Privacy Framework (adequacy decision of the European Commission of 10 July 2023, Art. 45 GDPR); the EU Standard Contractual Clauses apply in addition.

3. Consent, cookies and web analytics (Google Analytics)

On your first visit we ask you in a notice whether you consent to web analytics. We store your choice (consent or refusal) and its time in your browser’s local storage (entry “mbs_izin”) so that the notice does not appear on every page; we ask again after twelve months. This entry is strictly necessary to respect your choice (Section 25(2) no. 2 TDDDG) and is not sent to us or to third parties.

Only if you consent do we load Google Analytics 4, a web analytics service of Google Ireland Limited (address in section 2). Google Analytics then sets the cookies “_ga” and “_ga_…”, stored for up to two years, and records which pages you open, how long you stay, which page you came from, device type, browser, screen size and your approximate location (country, region, city). Google Analytics 4 does not store IP addresses. Google signals and ad personalisation are switched off. We only receive aggregated statistics and use them to improve the website.

The legal basis is your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). Google processes the data as our processor (Art. 28 GDPR); section 2 applies accordingly to transfers to the USA. Data in Google Analytics is deleted after 14 months.

Withdrawal: you can withdraw your consent at any time with effect for the future (Art. 7(3) GDPR) using the “Cookie settings” link at the bottom of every page. If you refuse or withdraw, Google Analytics is not loaded or is switched off, and the “_ga” cookies are deleted.

Fonts and images are loaded from our own web space. Without your consent, opening the website does not connect your browser to third-party servers.

4. Contact by email or phone

If you contact us by email or phone, we process the information you give us (for example name, company, email address, phone number and the content of your enquiry) in order to answer your enquiry.

Legal basis: Art. 6(1)(b) GDPR where your enquiry relates to a contract (for example a request for a quotation); otherwise Art. 6(1)(f) GDPR (legitimate interest in answering enquiries). Our email is operated through Google Workspace (Google Ireland Limited) as processor; section 2 applies accordingly to transfers to the USA.

We delete the data once your enquiry has been dealt with, unless statutory retention obligations apply.

5. Retention

If a contract is concluded, we keep commercial and business letters for six years and accounting records such as invoices for eight years (Section 257 HGB, Section 147 AO; Art. 6(1)(c) GDPR), in each case from the end of the calendar year.

6. Links to www.mbsbalans.com

Product information and technical data are available at www.mbsbalans.com. These are simple links; you only leave this website when you click one. The privacy notice of the respective page applies there.

7. Your rights

Subject to the legal requirements, you have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20). Please contact info@mbs-balance.com.

Right to object (Art. 21 GDPR): where we process data on the basis of Art. 6(1)(f) GDPR, you may object at any time on grounds relating to your particular situation.

8. Right to lodge a complaint

You may lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, Kavalleriestraße 2–4, 40213 Düsseldorf, Germany, www.ldi.nrw.de.

9. No automated decision-making

We do not use automated decision-making, including profiling (Art. 22 GDPR).
